Umrah: Tawaf ke liye haiz (mahwari) se paak hone ki sharth, sakht zaroorat ke waqt, khatam (saqit) hojayegi

Sawaal: Mai apne mulk se apne shohar ke sath umrah karne ke liye aayi hoon aur jeddah pahunchne par mujhe umrah shuru karne se pehle hi haiz (mahwari ya periods) aagaya. Chaar din ke baad, humari wapasi ki parwaz (flight) hai. Hum apni flight multawi (delay) nahi karsakte kyunke mere mahram yaani mere shohar ko zaroori wajah se wapas jaana hai. Iske alawa, mujhe dar hai ke mai dobara umrah karne ke liye wapas nahi aa sakungi. Haiz (mahwari) aane se pehle hi maine umrah ki niyyat karli thi aur ihram baandh chuki thi. Mere paas makkah mein rehne ka itna waqt nahi hai ke main paak ho jaaon aur pakeezgi ke halaath mein Umrah kar sakon. Is surat-e-haal mein mujhe kya karna chahiye? Apni zindagi mein yeh pehli baar umrah ke liye aayi hoon!

 

Jawaab ka Khulasa: Agar surat-e-haal aisi hai jaisa ke zikar kiya gaya hai, jahan aurat ko ihram ki haalat mein tawaf karne se pehle haiz (mahwari) aajaye, aur us ke mahram ko jald hi zaruratan safar karna padh jaaye aur uske saath (koi) mahram ya shohar makkah mein na ho toe, itni sakht zarurat ki wajah se, tawaf karne ke liye jo haiz (mahwari) se paak hone (taharat) ki sharth hai wo Khatam (hatt) hojaegi.

 

Answer: Alhumdulillah.

Sabse pehle,

Agar aap ke liye mumkin ho aisi dawai lena jissey haiz (mahwari) ruk jaye, baghair kisi nuqsan ke, toe aisa kar sakte hain. Agar khoon ka bahao band hojaye aur wo jagah sukhi hojaye, itni ke rui (cotton) ko us jagah lagane ke bawajood koi khoon ke dhabbe, peelapan ya kisi najasat nahi dikhti hai, toe aapko paak samjha jaaega. Is soorat-e-haal me aap paaki ki haalat me umrah kar sakti hain. Is baat se haiz waali aurton ka “tawaf karne se mana” ka joe ikhtilaf hai, wo duur hojaega, joe jamhoor ulama ka qaul hai.”

Abdur Razzaq (رحمه الله) ne apni Musannaf (318/1) mein bayan kiya hai: hum se Muammar (معمر) ne bayan kiya: hum se Ibn-e-Uyaynah (ابن عيينة) ke azad kiye hue ghulam Wasil ne ek shakhs ki sanad se bayan kiya ke Ibn-e-Umar (ابن عمر) se ek aurat ke baarey me pucha gaya jis ke haiz (mahwari) ka khoon taweel hogaya tha aur wo koi aisi dawa peena chahti thi joe ke khoon ko rok sake toe Ibn-e-Umar (ابن عمر) ko ismein koi harj nahi laga. Ibn-e-Umar ne “Arq” (miswak ki ek qism) ke darakht ka paani tajweez kiya. Muammar (معمر) ne kaha : mai ne Ibn Abi Nujayh (ابن أبي نجيح) se iske baare me sawal karte hue suna hai aur unko is mein koi harj nahi laga. 1https://shamela.ws/book/13174/1325

Ata (عطاء) se bhi ye riwayat hai ke unse ek aurat ke baare me pucha gaya jise haiz (mahwaari) aata hai aur use aisi dawa dee jaati hai jisse uska haiz ruk jaata hai jabke wo abhi haiz ki halath mein hi hoti hai. Kya wo tawaf kar sakti hai? Aap ne farmaya: haan agar wo paakeezgi dekhe. Lekin agar wo “Al khufuq” ko dekhti hai, baghair wazih safaid paakeezgi ke, toe phir nahi.”

“Al khufuq” ka matlab khoon ki ek choti ya ek halki si miqdaar hai joe haiz (mahwari) ke rukte waqt nazar aati hai. Aur Kashshaaf al-Qina (كَشّافُ القِناع), (1/218) mein hai :”haiz ko rokne ke liye halal dawa lena jaayez hai, ba-sharth ye ke us se koi nuqsan na ho”. 2https://shamela.ws/book/622/551

Dusri baat, agar haiz (mahwari) ko rokna mumkin na ho ya aisa karne se nuqsan pahunche toe aapko do raae ka saamna karna padega:

Pehli: Baghair haalat-e-ihram ke Makkah me dakhil ho sakte hain. Agar aap safar se pehle paak ho jaaein toe meeqat par wapas aakar, ihram baandh sakte hain aur umrah kar sakte hain. Agar aap paak nahi hue toe baghair umrah kiye wapas ja sakte hain, aur is mein koi harj nahi, khaas kar agar aap pehle umrah kar chuke hon. Is surat mein fardh ki adayegi puri ho chuki samjha jaayega, us qaul ke roshni mein jiske mutabiq umrah wajib hai.

Dusri: Khoon ko phailne se rokne ke liye ehtiyati tareeqe ekhtiyar karne ke baad aap umrah ka ihraam baandh sakte hain aur haiz (mahwari) ki halat me tawaf kar sakte hain. Yeh us qaul par mabni hai ke tawaf ke sahih hone ke liye taharat shart nahi hai, balke wajib hai, aur kisi durust uzr ki wajah se “Saqit” (khatam) hosakti hai ya badle me qurbani di ja sakti hai.

Ahnaaf ke nazdeeq yeh rai hai ke aisi surat-e-haal me tawaf sahi hai aur qurbani wajib hogi. Ahmed ki ek riwayat mein hai ke tawaf sahi hai, aur iske badley me ek bakri zubah karne ki zarurat hai. Shaikh-ul-Islam (رحمه الله) ne is qaul ko tarjeeh di ke tawaf uzr hone ki surat me jayez hai aur aurat se koi cheez matloob nahi hai.

Al Mardaawi (رحمه الله) kehte hain: Unka qaul “aur agar wo tawaf napaaki ki haalath me ya barhana haalath mein kare toe sahih nahi hoga” – Agar koi shakhs napaaki ki halat me tawaf kare. Madhab ka sahih qaul (aur jise ulama ne qubool kiya hai) yeh hai ke wo sahih nahi hoga. Al Qazi waghairah ne kaha ke ye apne tamam ahkam me namaz ki tarah hai, siwaye talaffuz ke yaani siwaye baat cheet ke mubah hone ke.

Aur ek qaul hai ke: ye sahih hai, aur qurbani se iski bharpayi (talaafi) hoti hai. Al-Furu (الفروع) me hai: “aur ek dusre qaul ke mutabiq iski bharpayi (talaafi) qurbani se hoti hai, agar wo shakhs makke me na ho, aur ghaliban musannif ka yahi matlab hai. Ek qaul ye bhi hai ke ye sirf uske liye jayez hai joe bhul jaye ya uzr rakhta ho, aur dusra qaul ye hai ke ye sirf un do qismon ke liye jayez hai jisme qurbani zaruri hai. Ye bhi qaul hai ke ye haaiza aurat ke liye jayez hai aur uski bharpayi (talaafi) qurbani se karni chahiye joe ke Al-Qazi ka zaahiri bayan hai. Sheikh taqiuddin ne ye nazariya ikhtiyar kiya ke ye us aurat ke liye aur har uzr waale ke liye jayez hai aur unme se kisi ek se bhi qurbani ki zarurat nahi hai. Aap ne farmaya: uske liye taharat (paaki ka hona) wajib hai ya sunnat? Ahmed aur deegar ke nazdeeq uske do raae hain. Lihaza, aap shaikh-ul-Islam (رحمه الله) ke qaul ki pairvi kar sakte hain, Agar aap paak nahi hue aur makkah me nahi reh sakte.

Lajnah Daimah Fatwa committee ke ulama se sawal kiya gaya:“ek aurat ihram ki halat mein umrah karne aayi, lekin makkah pahunchne ke baad usey haiz (mahwari) aagaya. Us aurat ke mahram ko fauri taur par safar karna padh jaye aur us aurat ka makkah mein koi na ho, (aisi halat mein) kya hukm hai?”

Unhone ne jawab diya: “Agar surat-e-haal aisi hi hai jaisa ke bayan kiya gaya hai, jahan aurat ko ihram ke halat mein tawaf karne se pehle haiz aajata hai aur uske mahram ko fauran safar karna padh jaye, aur makkah mein us aurat ka koi mahram ya shohar na ho, toe masjid mein dakhil hone aur tawaf karne ke liye jo haiz (mahwari) se paak hone ki sharth hai wo zarurat ki wajah se khatam (saqit) hojayegi. Wo aurat sanitary pad ya kapda istemal kar sakti hai aur apne umrah ke liye tawaf aur saee kar sakti hai, illa ye ke us aurat ke liye phir se umrah ke liye laut ke ana apne shohar ya mahram ke saath mumkin ho. Is surat mein wo aurat safar kare aur jab haiz band hojae toe paak ho kar umrah ka tawaf karne wapas aaye. Allah farmata hai:“Allah taala tumhare liye asani ka irada karta hai aur tum par sakhti nahi chahta.” Wo ye bhi kehta hai:“Allah kisi jaan ko uski bardasht se zyada takleef nahi deta.” Aur farmata hai: “aur usne tumhare liye deen mein koi tangi nahi ki”. Aur farmata hai: “pas Allah se daro jotna tum se hosakta hai.”

Rasul Allah (ﷺ) ne farmaya: “Jab mai tumhein kisi kaam ka hukum doon toe usmein jitna hosake karo”. Ye aur deegar nusoos asaani ku ubhaarti aur mushkilat ko duur karti hain, Shaikh-ul-Islam Ibn-e-Taymiyyah (رحمه الله) aur unke shagird Ibn-ul-Qayyim (رحمه الله) samet bahut se ulama ka yehi mauqif tha. [yeh Fatawa Islamiyyah (2/238) se naqal kiya gaya hai].

Shaikh Ibn-e-Uthaymeen (رحمه الله) se pucha gaya ke ek aurat ko haiz (mahwari) aaya aur usne Tawaf-e-Ifadha nahi kiya. Wo mamlaka se bahar rehti ho,aur uske wapas hone ka waqt aagaya ho, aur wo aurat apni rawangi mein der nahi karsakti, aur uske liye dobara mamlaka mein wapas aana na mumkin ho. kya hukm hai?”

Unhone jawab diya: “Agar surat-e-haal is tarah ho ke jahan aurat ne tawaf-e-ifadha nahi kiya aur haiz (mahwari) ajaye aur tawaf karne se pehle safar karne se uska makkah mein rehna ya wapas aana namumkin hai, toe is surat mein wo do mein se ek option ka intekhab kar sakti hai: Ya toe wo khoon ko rokne keliye dawa istemal karsakti hai aur tawaf karsakti hai, Ya phir wo zarurat ki wajah se kapda istemal karke khoon ko masjid mein jaane se rok sakti hai aur tawaf karsakti hai. Ye rai, jise hum ne zikar kiya hai, sab se zyada sahih hai aur ise Shaikh-ul-Islam Ibn-e-Taymiyyah ne muntakhab kiya hai.

Dusre tareeqe yeh do mein se ek hain: ya toe wo halat-e-ihram mein rahein, yaani wo apne shohar ke liye halal nahi hosakti, aur na hi koi is se shadi karsakta hai agar wo shadi shuda na ho. Ya usey “muḥṣirah” (majboor) samjha jaata hai, aur us aurat ko janwar ki qurbani karni hogi aur wo ihram se bahar hosakti hai. Is surat mein uska haj sahi nahi hai. Ye dono option mushkil hain.

Lihaza tarjeehi hukm wahi hai jise shaikh-ul-islam Ibn-e-Taymiyyah (رحمه الله) ne zaruri halat mein bayan kiya hai, jaisa ke Allah taala ka farmaan hai: “usne tumhare liye deen mein koi mushkil nahi rakhi”. Aur farmata hai: “Allah tumhare liye asaani ka irada karta hai aur tum par sakhti nahi chahta.”

Jo bhi ho agar aurat safar karne ki istetaat rakhti ho aur phir paak hone par wapas laut sakti hai, toe uske safar karne mein koi harj nahi. Ek baar jab wo paak hojaye toe wo wapas aakar haj ka tawaf karsakti hai. Is dauran wo apne shohar ke liye halal nahi hai kyunke usne ihram se dusri rehayi mukammal nahi ki hai. Yeh baat wazih rahe ke is halath mein tawaf sirf un auraton ke liye jayaz hai jinke paas aisa “UZR” (wajeh) hai aur jo aisi mashaqqat mien hai. Warna haaiza aurat ko tawaf karne se mana kiya gaya hai.

Allah humarey aamaal ko qubool farmaye.

Aur Allah hi behtar jaanta hai.
